Terms of Service

By accessing and using AiLx (the "Service"), you accept and agree to be bound by these Terms of Service ("Terms"). These Terms govern your use of our AI-powered learning platform, including but not limited to AI question generation, mock test creation, course generation, study planning, study groups, analytics, and all related services. If you do not agree to these Terms, you may not use the Service.

Account Creation: To use certain features of the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Eligibility: You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

Account Security: You are responsible for maintaining the security of your account and must notify us immediately of any unauthorized access or use of your account.

Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

Subscription Plans: AiLx offers Free, Student, and Professional subscription plans with different features and usage limits. Plan features, pricing, and limits are subject to change with notice.

Payment Processing: Payments for paid subscriptions are processed through PayPal. By subscribing, you agree to PayPal's terms and conditions. We do not store your payment card information.

Billing: Subscriptions are billed monthly or annually as selected. Monthly subscriptions renew automatically each month. Annual subscriptions renew automatically each year. You will be charged the then-current subscription fee.

Cancellation: You may cancel your subscription at any time through your account settings or PayPal account. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until the end of your billing period.

Refunds: Refunds are provided at our discretion and in accordance with applicable law. Generally, we do not provide refunds for partial billing periods, but you may contact us to discuss your situation.

Usage Limits: Each subscription plan has specific usage limits (e.g., number of questions generated per month, courses created, study groups). Exceeding these limits may require upgrading your plan or waiting until the next billing cycle.

Your Content: You retain ownership of all content you upload, create, or generate using the Service, including documents, knowledge bases, questions, courses, study plans, and notes ("User Content").

License to AiLx: By uploading or creating User Content, you grant AiLx a worldwide, non-exclusive, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing and improving the Service, including AI processing for question generation, course creation, and other features.

AI-Generated Content: Content generated by our AI features (questions, courses, explanations) is created using your input and our AI technology. You own the rights to AI-generated content created from your User Content, but you may not claim ownership of the underlying AI technology or algorithms.

Prohibited Content: You agree not to upload, create, or share content that is illegal, harmful, threatening, abusive, defamatory, infringing on intellectual property rights, or violates any third-party rights. We reserve the right to remove any such content and terminate accounts that violate this provision.

AiLx Intellectual Property: The Service, including its design, features, AI technology, algorithms, and software, is owned by AiLx and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our written permission.

AI Question Generator: You may generate questions from uploaded documents, knowledge bases, or topics searched from the web. Questions are generated using AI technology and may not always be accurate or complete. You are responsible for reviewing and validating generated questions.

AI Mock Test Generator: You may create mock tests with customizable settings. Test results and analytics are provided for educational purposes and should not be used as the sole basis for academic or professional decisions.

AI Course Generator: You may generate courses from your knowledge bases. Generated course content is AI-created and should be reviewed for accuracy and completeness.

Study Groups: You may create and join study groups to collaborate with other users. You are responsible for your conduct in study groups and for any content you share. We are not responsible for the actions or content of other group members.

Web Search Integration: When using web search-based question generation, we search publicly available web sources. We are not responsible for the accuracy, completeness, or legality of content from external web sources.

File Uploads: You may upload documents (PDFs, text files) subject to file size limits based on your subscription plan. You are responsible for ensuring you have the right to upload and process any documents you submit.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Upload malicious software, viruses, or harmful code
• Attempt to reverse engineer, decompile, or hack the Service
• Use automated systems to access the Service without permission
• Impersonate others or provide false information
• Interfere with or disrupt the Service or servers
• Use the Service for commercial purposes beyond your subscription limits
• Share your account credentials with others
• Use the Service to create content that violates academic integrity policies

Service Availability: The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We may experience downtime for maintenance, updates, or technical issues.

AI Accuracy: AI-generated content, including questions, courses, explanations, and recommendations, is generated using artificial intelligence and may contain errors, inaccuracies, or incomplete information. You should review and validate all AI-generated content before use.

No Academic Guarantee: The Service is an educational tool and does not guarantee improved academic performance, test scores, or academic success. Results may vary based on individual effort and circumstances.

Third-Party Content: The Service may include content from third-party sources, including web search results. We do not endorse or guarantee the accuracy of third-party content.

No Warranties: To the fullest extent permitted by law, AiLx disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, AiLx and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of the Service.

Maximum Liability: Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Educational Use: You acknowledge that the Service is an educational tool and that any decisions made based on AI-generated content, test results, or analytics are solely your responsibility.

Data Loss: While we implement security measures, we are not responsible for any loss of data, including uploaded documents, generated content, or account information, due to technical failures, security breaches, or other causes beyond our reasonable control.

You agree to indemnify, defend, and hold harmless AiLx and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you upload, create, or share through the Service

Termination by You: You may terminate your account at any time by deleting your account through your account settings or contacting us.

Termination by Us: We may suspend or terminate your account immediately, without notice, if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect the Service or other users.

Effect of Termination: Upon termination, your right to use the Service will immediately cease. We may delete your account and User Content, subject to our data retention policies. You will not be entitled to any refund for unused subscription time unless required by law.

Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

Changes to Service: We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Feature Updates: We may add, remove, or modify features, subscription plans, and usage limits. We will provide reasonable notice of material changes that affect your subscription.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AiLx operates, without regard to its conflict of law provisions.

Dispute Resolution: Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in a court of competent jurisdiction, as applicable.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AiLx regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment: You may not assign or transfer your account or these Terms without our written consent. We may assign these Terms without restriction.
